(KALAMAZOO) – The trial of St. Joseph County Prosecutor John McDonough scheduled for this week has been postponed.
According to officials with Kalamazoo County District Court, the delay is due to a local administrative order that discontinues jury trials when the number of COVID-19 cases exceeds a threshold that has been set by the Michigan Supreme Court.
McDonough was supposed to have a settlement conference on Tuesday. If no settlement was reached, then a jury trial would have started Tuesday as well.
McDonough is facing a charge of driving under the influence of alcohol in a May 11 incident in the 17,000 block of Lovers Lane in Lockport Township. He was involved in a one vehicle crash, as his automobile left the road and crashed into a fence. The St. Joseph County Sheriff's Department was called to the scene and found a black SUV parked on the north side of the road, facing east. McDonough was the lone occupant of the vehicle.
Kalamazoo court officials say a tentative date of January 21 has been set for the settlement conference. If no agreement is reached, then a jury trial would start January 22.
McDonough has been the St. Joseph County Prosecutor for 12 years. He was defeated in August by David Marvin in the Republican Primary.
